1. Definitions and Acceptance of Terms
These Terms and Conditions (“the Terms”) constitute a binding agreement between Jamie Fitzjohn (“the Mentor”) and any individual who engages the Mentor’s services (“the Client”), and further govern the use of any content produced, published or distributed under the Mentor’s name or brand by any individual (“the User”). For the purposes of these Terms, “the Services” refers to all mentorship services provided by the Mentor, including but not limited to individual sessions, packages of sessions, recurring monthly arrangements and any associated communication, and “the Content” refers to all material produced by the Mentor in any format. These Terms apply to all Services from the point of first engagement. By booking a session, submitting payment, initiating contact for the purpose of commencing the Services, or participating in any session or Service, the Client confirms that they have read these Terms in full, understand their meaning and effect, and agree to be bound by them. Any Client who requires clarification of any provision of these Terms should contact the Mentor prior to engaging the Services. Any individual who does not accept these Terms, in whole or in part, must not book, purchase or make use of the Services.
2. Nature and Scope of the Services
The Services constitute non-clinical peer mentorship based exclusively on the Mentor’s personal lived experience of behavioural addiction. The Mentor does not hold any professional qualifications, licences, registrations or accreditations in the fields of addiction, mental health or medicine. The Mentor is not a therapist, counsellor, psychologist, psychiatrist, medical practitioner, nurse, social worker or any other licensed or regulated healthcare professional, and makes no representation to the contrary. The Mentor does not diagnose, assess, treat or cure any addiction, psychological condition, psychiatric condition or medical condition. The Services do not constitute therapy, counselling, medical advice, clinical intervention or crisis support, and must not be regarded as a replacement for or substitute for any such service. No information, statement or material provided by the Mentor shall be construed as, or relied upon as, professional, medical, psychological, legal or financial advice. This provision applies to the Services and to all Content, including but not limited to calls, written messages, voice notes, social media publications, video material, written material and information published on the Mentor’s website or any other platform. All such Content reflects solely the personal experience, views and opinions of the Mentor, and the Mentor makes no representation that any approach described will be suitable or effective for any other individual. Any Client who has, or suspects they may have, a psychological, psychiatric or medical condition, or any other matter requiring professional attention, is advised to consult a suitably qualified professional. The Services may be undertaken in conjunction with professional treatment but must not be undertaken as an alternative to it.
3. Eligibility
The Services are available exclusively to individuals aged 18 years or over. The Mentor does not provide the Services to any individual under the age of 18 in any circumstances. By accepting these Terms, the Client warrants that they are aged 18 years or over and that all information provided to the Mentor regarding their age is true and accurate. Should it subsequently be established that the Client is under the age of 18, the Services will be terminated with immediate effect. By accepting these Terms, the Client further confirms that they are not, at the time of engaging the Services, experiencing a crisis or emergency. The Services are not designed or equipped to support individuals in crisis, and any individual to whom this applies must follow the procedure set out in Section 4 of these Terms and seek immediate assistance from the appropriate services.
4. Crisis and Emergency Situations
The Mentor does not provide crisis intervention or emergency support of any kind. The Client acknowledges that the Mentor may not be able to receive or respond to messages, voice notes or calls immediately, and accordingly the Services must not be relied upon in any emergency situation. In the event that the Client is in immediate danger, is experiencing thoughts of harming themselves or another person, or otherwise requires urgent assistance, the Client must contact the emergency services in their location without delay (for example 999, 911 or 112, as applicable) or attend the nearest hospital emergency department. The Client may also contact a crisis helpline in their country of residence, details of which are available at findahelpline.com. In such circumstances the Client must not await a response from the Mentor. Where information disclosed by the Client gives the Mentor reasonable grounds to believe that the Client or any other person is at serious risk of harm, the Mentor may recommend that the Client seek professional assistance and, where the Mentor considers it necessary for the protection of the Client or any other person, may contact the emergency services.
5. Delivery of Services and Communication
The Services are delivered remotely and are available to Clients in any location. Sessions and ongoing support are conducted by means of live telephone or application-based calls, voice notes and written messages transmitted through third-party messaging applications, including but not limited to WhatsApp and Signal. In respect of voice notes and written messages, the substantial majority receive a response within one (1) to six (6) hours, and the Mentor endeavours to respond to all such communications within twelve (12) hours. The Mentor’s standard policy is that all voice notes and written messages will receive a response within a maximum of seventy-two (72) hours. The Client acknowledges that response times may be affected by differences in time zone, travel and the Mentor’s availability. Communication by message or voice note does not constitute crisis or emergency support and must not be used as such. In any situation requiring urgent assistance, the Client must follow the procedure set out in Section 4 of these Terms.
6. Fees, Payment and Refund Policy
The Services may be offered on a per-session basis, as a package of sessions, or by way of recurring monthly payment, according to the nature of the Service selected. Details of the Services currently offered and the applicable fees are published on the Mentor’s website at jamiefitzjohn.com, which shall be regarded as the authoritative source of current pricing information. Certain Services may be available on request only, and where the fee for a Service is not published, the Client may request it directly from the Mentor. The Mentor reserves the right to amend the Services and the applicable fees at any time; however, no such amendment shall affect any Service for which payment has already been received. Payment must be made in full prior to the commencement of any Service, and no session or support shall be provided until payment has been received. By submitting payment, the Client expressly requests that the provision of the Service commence immediately and acknowledges that, to the fullest extent permitted by applicable law, any statutory right of cancellation and refund is forfeited upon commencement of the Service. All payments are final and non-refundable. To the fullest extent permitted by applicable law, no refunds shall be issued and no cancellations shall be accepted for any reason, including in respect of any session, package or period of Service that the Client does not use. Any session that the Client fails to attend shall be deemed to have taken place, shall be counted as a session used, and shall not be rescheduled or refunded. Where the Client attends a session late, the session shall conclude at its originally scheduled time, and any time lost as a result shall not be extended, rescheduled or compensated.
7. Suitability, Availability and Termination of Services
The provision of the Services is subject to the Mentor’s availability and to the Mentor’s assessment of whether mentorship is appropriate to the individual’s circumstances. Where the Mentor’s availability does not permit the commencement of Services, or where it appears that an individual’s needs would be more appropriately addressed by a qualified professional, including in cases involving a mental health condition, the Mentor may be unable to offer the Services. In the interests of the Client’s wellbeing, the Mentor may also bring the Services to an end at any time where it becomes apparent that the Client requires professional support that falls outside the scope of mentorship, or where the Client has acted in breach of these Terms. In any such case, the Mentor’s intention is to ensure that the Client is directed towards the most appropriate form of support, and the Mentor may recommend that the Client seek assistance from a suitably qualified professional.
8. Confidentiality and Data Protection
All information disclosed by the Client in the course of the Services shall be treated as confidential and shall not be disclosed to any third party, save in the following circumstances: where the Mentor has reasonable grounds to believe that the Client or any other person is at serious risk of harm; where disclosure is required by law; or where the Client has provided consent to the disclosure. The Mentor does not create or retain separate notes, files or records relating to any Client. Any messages, voice notes or call history arising from the Services are held solely within the third-party messaging application used for communication, such as WhatsApp or Signal, and are subject to the privacy policy, security measures and terms of service of that application. As the Mentor does not own or control such applications, the Mentor accepts no responsibility for the manner in which they store, process or protect data. The Client’s name, personal history or any other personal information shall not be used for any other purpose, including testimonials or any form of public content, without the Client’s prior written consent.
9. Intellectual Property, Recordings and Use of Likeness
All Content, including but not limited to sessions, calls, voice notes, written messages, video material, written material and any other material produced under the Mentor’s name or brand, is and shall remain the intellectual property of the Mentor. The Services and any Content provided to the Client are supplied solely for the Client’s personal, non-commercial use. Without the Mentor’s prior written consent, the Client shall not record, capture by screenshot or otherwise retain any session or call for the purpose of disclosure to any third party, nor share, publish, sell, forward or otherwise distribute any voice note, message or other Content in any form. The Client shall not edit, alter, excerpt, manipulate or misrepresent the context of the Mentor’s voice, facial likeness, image or words by any means. The Client shall not use the Mentor’s voice, facial likeness, image or name in connection with any artificial intelligence system, voice synthesis or cloning software, deepfake technology or any comparable technology, whether currently in existence or developed in the future. The Client shall not represent any material as originating from, or being endorsed by, the Mentor where this is not the case. Any breach of this Section shall entitle the Mentor to terminate the Services with immediate effect and without refund, and the Mentor reserves all further rights and remedies available.
10. Client Responsibility and Limitation of Liability
The Client retains full responsibility for their own decisions, actions and wellbeing at all times, both during and following the provision of the Services. Any decision made or action taken by the Client on the basis of the Services or the Content is made or taken solely at the Client’s own discretion and risk. The Mentor gives no guarantee or warranty as to any particular outcome or result of the Services, including but not limited to recovery from any addiction or any change in behaviour. To the fullest extent permitted by applicable law, the Mentor shall not be liable for any loss, harm, injury or damage of any kind, whether direct, indirect or consequential, arising from or in connection with the use of the Services or the Content. Where the Mentor is found to be liable, the Mentor’s total aggregate liability to the Client shall be limited to the fees paid by the Client for the specific Service giving rise to the claim. Nothing in these Terms shall operate to limit or exclude any liability which cannot lawfully be limited or excluded.
11. Amendments to these Terms
The Mentor may amend these Terms from time to time, including to reflect changes to the Services, the applicable fees or the manner in which the Services are delivered. The current version of these Terms shall at all times be published on the Mentor’s website at jamiefitzjohn.com, and it is the Client’s responsibility to review the website for any amendments. No amendment to these Terms shall affect any Service for which payment was received prior to the date of that amendment.
12. Contact Information
Any enquiry relating to these Terms, the Services or any other matter connected with the Mentor may be directed to Jamie Fitzjohn by email at hello@jamiefitzjohn.com or by way of the Mentor’s website at jamiefitzjohn.com. The Mentor will endeavour to respond to all enquiries within a reasonable period.
13. Declaration and Acceptance
By ticking the acceptance box, signing below or submitting payment, the Client declares that they are aged 18 years or over and that they have read, understood and agree to be bound by these Terms in their entirety. The Client acknowledges that the Mentor is not a qualified professional and that the Services do not constitute therapy, counselling, medical advice or crisis support, nor a substitute for any such service. The Client expressly requests that the provision of the Services commence immediately and acknowledges that all payments are final and non-refundable. The Client further undertakes not to record, edit, distribute, alter or otherwise use the Mentor’s voice, likeness, image, name or Content in any manner without the Mentor’s prior written consent.
